Shen Qi Medical Centre is the controller for the processing of your personal data via our practice and website.

2. What personal data we process

   2.1 Clients (in-person consultations)

* Identification and contact details: name, address, email, telephone number, date of birth (where relevant for treatment/administration).

* Health data (medical record): presenting complaint, anamnesis, treatment plan, treatment notes, evaluations and, where relevant, information about medication/contra-indications.

* Administration: invoice and payment details (cash, debit card (PIN), or bank transfer).

Online/video consultations

* We currently do not offer video consultations.

2.2 Website visitors

* Technical/basic: IP address and standard server logs required to display and secure the website.

* Forms: data you provide yourself (e.g., via a contact form).

2.3 Minors

* We treat minors in accordance with Dutch law: under 12 with consent of parent(s)/guardian; ages 12–16 with consent of both the parent(s)/guardian and the minor; from 16 the client decides for themselves.

3. Purposes and legal bases

   We process personal data for:

* Healthcare provision (acupuncture and related TCM treatments): planning, delivering and evaluating treatments.

  Legal basis: performance of (treatment) contract; for health data: provision of healthcare by/under the responsibility of a professional bound by confidentiality (GDPR Art. 9(2)(h)).

* Practice management & administration: scheduling, invoicing, accounting, debtor management.

  Legal basis: contract, legal obligation (e.g., fiscal retention) and legitimate interests.

* Communication: responding to questions and requests.

  Legal basis: contract and legitimate interests.

* Website operation and security: to display and secure the site.

  Legal basis: legitimate interests.

We do not submit claims directly to health insurers. You submit claims yourself using our invoice. We do not share medical data with health insurers.

4. Sharing of personal data

   We only share your data where necessary with:

* Service providers/processors:

  • Hosting provider for website hosting.

  • Email/IT support (if applicable).

  • Accountant/bookkeeper (administration/invoicing).

  • Payment handling: bank/terminal provider for debit card payments.

* Other healthcare providers (e.g., your GP or specialist) only with your consent, unless a legal obligation requires otherwise.

* Authorities where we are legally required to do so.

We never sell your personal data. Transfers outside the EEA are not envisaged; if ever necessary, we will implement appropriate safeguards (such as EU Standard Contractual Clauses).

5. Retention periods

* Care/medical record: in principle 20 years after the last treatment contact (statutory medical retention period).

* Financial administration/invoices: 7 years (fiscal retention).

* Correspondence and contact forms: up to 2 years after completion, unless part of the medical record.

* Website log data: no longer than necessary for security and operation.

6. Security

   We implement appropriate technical and organisational measures, including: encrypted connection (HTTPS) and up-to-date systems; restricted, role-based access to client data; strong passwords and, where possible, two-factor authentication; paper files (if used) kept in a locked cabinet/room; encrypted backups and periodic security reviews.

7. Your rights

   You have the right to access, rectification, restriction, erasure (insofar as compatible with statutory retention), data portability and to object to certain processing. You may withdraw consent at any time.

   Please send your request to: info@shenqi.nl. We will respond as soon as possible and within one month. You also have the right to lodge a complaint with the Dutch Data Protection Authority (Autoriteit Persoonsgegevens).

8. Cookies (brief)

   Our website uses only functional/technically necessary cookies to keep the site working and secure. We do not place analytics or marketing cookies and currently do not use a cookie tool/banner. If this changes (e.g., if we add analytics or third-party embedded services), we will update this policy and request consent where required.
